What this covers
These terms apply to any material you send us or allow us to use: photographs, video, captions, reviews, trip reports, corrections, tips and messages. We call all of it "your content" below. "We", "us" and "our" mean BeyondBorder Group Ltd, the Hong Kong company that publishes Visit Moganshan.
They apply whether you sent the material to us directly, replied to a request from us on a social platform, or agreed in writing by any other means. They sit alongside ourterms of use and our privacy policy.
How we ask
When we see a photograph of Moganshan we would like to publish, we contact the person who posted it, on the platform where we found it, and we link to this page. Platforms include Instagram, Xiaohongshu, Weibo, YouTube, Douyin, Flickr, Facebook and any similar service.
We do not treat a public post, a hashtag or a location tag as permission. Tagging a photograph #moganshan is not an offer to us. We ask, every time, and we publish nothing until somebody says yes.
The permission you give
You keep the copyright in your content. Nothing here transfers ownership of anything, and you remain free to publish, license or sell your own work to anybody else, including our competitors.
What you give us is permission: a worldwide, royalty free, non exclusive licence to use, store, reproduce, display and publish your content on Visit Moganshan and on our own social media accounts and newsletters, together with the right to crop, resize, compress, colour correct and caption it so it fits the page it appears on. We may keep a copy for our records after it comes down, so that we can show what was published and when.
Where you have given permission over a public reply or a message, we may also show your username or name alongside the content, which is normally what crediting you requires.
What we will not do
This is a licence to publish a travel guide, not a blank cheque. Without asking you separately and agreeing terms, we will not:
- sell, sublicense or syndicate your content to another company;
- use it in paid advertising, on merchandise, or in a printed product for sale;
- use it to advertise a hotel, an operator or any other business;
- edit it in a way that changes what it shows, or place it beside a caption implying something the picture does not support; or
- use it to train a machine learning model, or supply it to anybody else for that purpose.
Credit
We credit by name or by handle wherever the format allows, and we link to your profile when you give us one. If you would rather not be credited, or want a specific name used, tell us and we will follow that. Being asked for a credit and then not receiving one is a fair reason to ask us to take the content down, and we will.
What you confirm
By giving us permission, you confirm that:
- the content is yours, or you hold every right needed to grant this permission, including from any photographer, editor or collaborator involved;
- publishing it will not breach anybody else's copyright, trade mark, privacy, publicity, confidentiality or contractual rights;
- it is accurate as far as you know, and where it is a review or a trip report, it describes your own genuine experience;
- you have not been paid or otherwise rewarded by a business to write it, or if you have, you have told us; and
- it is not defamatory, obscene, abusive, harassing, hateful, threatening, misleading or otherwise unlawful.
People in the frame
If somebody is identifiable in your photograph or video, you confirm you have their agreement for it to be published on a public travel site. If a child is identifiable, you confirm you have the agreement of a parent or guardian. Where a person later objects to appearing, we will remove the content rather than argue about it.
Age
You must be 18 or over to give us permission. If you are under 18, ask a parent or guardian to contact us and give permission on your behalf.
Moderation
We choose what to publish, and we edit for length, clarity and house style. Not everything sent to us is used, and a request from us is not a promise to publish.
We decline content that is unsafe to copy, such as trespass on closed land or driving advice we would not stand behind; content that names or targets an individual member of hotel staff; content that reads as a planted or paid review; and anything we cannot verify well enough to put our name to. Declining is not a judgement on you, and we do not publish our reasons.
Taking it down
You can withdraw permission at any time, for any reason, without explaining yourself. Write tohello@visitmoganshan.com and tell us which content you mean. We remove it from the site within five working days, and from our social accounts as soon as the platform allows.
Two honest limits. Copies already cached by search engines, archives or other people's reposts are outside our control, and material already sent in a newsletter cannot be recalled from inboxes. We will help you chase a cache where we can.
We may also remove your content ourselves at any time, without notice, if we believe it breaches these terms or has stopped being accurate.
If it was not theirs to give
If you believe something published here is your work and was given to us by somebody else, write to hello@visitmoganshan.com with the page address, the content in question and enough detail to identify your rights in it. We take it down while we look, not after. Getting that order the wrong way round is how publishers turn a mistake into a dispute.
Payment and your data
Content published under these terms is unpaid on both sides. You are not charged, and no fee, royalty or commission is due to you now or later. Where we commission work, we agree that separately and in writing, and these terms do not apply to it.
Your name, handle and contact details are handled under our privacy policy, which sets out what we keep, for how long and how to have it deleted. We keep a record of the permission itself for as long as the content is published, plus two years, because that record is the only proof either of us has that you said yes.
General
This permission is personal to us and we cannot transfer it without your written agreement, except to a company that acquires the Visit Moganshan business as a whole. If we do not enforce part of these terms straight away, we have not given it up. If any part is found unenforceable, the rest stands. These terms are governed by the laws of Hong Kong, and the courts of Hong Kong have exclusive jurisdiction, without depriving you of mandatory consumer protections in your own country.
We may update this page. The version that applies to your content is the one published on the date you gave permission, and the date at the top of this page is the current version.
Confirming
If we have asked to use your photograph on a social platform, reply publicly to that request with the tag #MoganshanYes. That reply confirms that you have read this page, that you agree to these terms, and that you are giving us permission to publish the content we asked about.
If you would rather agree in writing instead, or want to change any part of this before you say yes, email hello@visitmoganshan.com and we will sort it out there. Saying no costs you nothing and we will not ask twice.
